These Terms of Service (“Terms”) govern your access to and use of the website located at colemanandcompanypeptides.com and related pages (the “Site”), and any services or features we offer through the Site. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Coleman & Co. Peptide and Aesthetic Care, LLC is a single-member Florida limited liability company with no board of directors.
Our collection, use, and disclosure of information—including protected health information—is further described in our Privacy Policy, which includes HIPAA-aligned practices for clients.
1. Eligibility and account
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site in connection with our services. If you create an account or use member-only areas, you agree to provide accurate information and to keep your login credentials confidential. You are responsible for activity under your account.
2. Not medical advice; no doctor–patient relationship
Content on the Site (including educational materials, pricing information, blog posts, and general descriptions) is for informational purposes only. It is not medical advice, diagnosis, or treatment. 9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, COLEMAN & CO. PEPTIDE AND AESTHETIC CARE, LLC, ITS SOLE MEMBER, AND ITS EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR SERVICES DIRECTLY RELATED TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE PROHIBITED BY LAW.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Coleman & Co. Peptide and Aesthetic Care, LLC, its sole member, and its employees, contractors, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any third-party rights.
11. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where preempted by federal law.
Unless we agree otherwise in writing or applicable law requires a different forum, you agree that exclusive jurisdiction for any dispute arising out of these Terms or the Site shall lie in the state or federal courts located in Pinellas County, Florida, and you consent to personal jurisdiction there.
Informal resolution: Before filing a claim, you agree to contact us at the email below and attempt to resolve the dispute in good faith for at least thirty (30) days.
12. Changes to these Terms
We may modify these Terms at any time by posting the updated version on this page and updating the “Effective date.” Your continued use of the Site after the effective date constitutes acceptance of the revised Terms, except where applicable law requires additional steps.
13. Miscellaneous
If any provision of these Terms is held invalid, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms constitute the entire agreement between you and us regarding the Site (subject to separate written agreements for specific services).
